Cost-Effective Options to Resolving Your Legal Case
Alternative Dispute Resolution: Negotiation &mdot; Mediation &mdot; Arbitration
In many conflicts, you have the benefit of being able to seek a resolution through the courts. But such a resolution always comes at a cost in time, money and, frequently, your relationship with the other party.
Alternative dispute resolution, also called ADR, is the term used to describe other methods for resolving legal disputes. ADR includes negotiation, mediation and arbitration.
The Colorado judiciary has recognized these ADR methods as effective complements to the judicial system. It is increasingly ordering mandatory mediation, arbitration, settlement conferences or the appointment of a Special Master (court-ordered magistrate, auditor or examiner) in cases involving:
- Child custody and visitation
- Divorce and property settlement
- Consumer disputes
- Real estate disputes
- Business disputes
- Intellectual property dispute
By employing a lawyer from Schunk & Dunn as your neutral third-party mediator or arbitrator, you are engaging an attorney with significant experience, both in ADR and in the courtroom. Mr. Dunn has received a Certificate in ADR from The Ohio State University. His diverse legal experience allows him to more effectively and impartially assess the merits of your case and offer possible resolutions for you to consider.
The Benefits of ADR
There are many good reasons why you may wish to begin with negotiation or mediation to resolve a family law or real estate matter. Reaching a resolution through ADR is typically faster, more cost-effective, and allows for more creative and personalized solutions. Additionally, a mediated settlement is private, unlike taking a case to court.
If you are party to a contract that requires arbitration, you can expect similar benefits.
ADR is Not Appropriate for Every Case
ADR is not useful in all cases, especially where prompt action is required to prevent harm. Even if the court requires ADR before it will set a date for trial, a person or company has a right to object to that requirement. Reasons you may do so could include past physical or psychological abuse, prohibitive costs or previous failed attempts to resolve the matter.
